Please read these Terms and Conditions carefully and in its entirety before using kefiwellness.com, Purchasing or Downloading from our Site, partaking in any capacity /purchasing Courses, Services, and/or Products (hereinafter referred to as the “Site” or “Kefi Wellness’’).

The Site and its content are owned by Kefi Wellness. This document represents a legal document and is the Terms and Conditions (Agreement) for our site and all our services.

These Terms & Conditions are published to clearly explain, outline, and layout the rules, terms, and conditions of using, viewing, and/or browsing the Site, social media linked to this company and/or purchasing or downloading any course, program, service, or product offered by Kefi Wellness or the Site.

Your consent to these terms & conditions

By proceeding with interaction with Kefi Wellness and it’s Site or Purchasing, Downloading from our Site, partaking in any capacity /purchasing Courses, Services, and/or Products you implicitly and voluntarily agree that you have read (or had the opportunity to read and chose not to), understood, and consented to these Terms & Conditions as stated herein.

Our Relationship to You thought this Agreement in no way creates any agency, partnership, joint venture, employee-employer or franchisor-franchisee relationship between you and Kefi Wellness

You hereby agree to take full responsibility for yourself, your health and release, indemnify and hold harmless, Beth Jex and Kefi Wellness. You are entering a community for natural health & healing and seeking information and products based on those principles thereby granting a private license to the above to provide you the information herein.

Definitions

“Company”, ‘Site’’, “We”, “I”, “Our”, or “Us” means Kefi Wellness and our website, kefiwellness.com

“Content” means any and all written, visual, video, or audio information contained on the Site, including, but not limited to, any and all emails received from Kefi Wellness and any and all written or downloadable material purchased, viewed, or otherwise offered by Kefi Wellness including, but not limited to, blog posts, graphics, newsletters, designs, documents, information, templates and materials.

“Personal Information” means information that can be used on its own or in conjunction with other information to identify, contact, or locate a person, or to identify an individual in context. For example, personal information includes, among other things, your name, address, email address, telephone number, credit card information, site behaviour, etc.

“Site, Courses, Services, and/or Products” means Kefi Wellness content (as defined herein), email list/newsletters, social media posts, blog posts, courses, coaching services, guides, eBooks, forms, worksheets, workbooks, webinars, website materials, software applications, and/or templates available on the Site.

“Site” means Kefi Wellness and any and all of its associated pages, tabs, landing pages, forms, or sub-pages.

“You” or “Your” means the user, customer, or viewer of the Site.

Site rules

By using the Site and/or making any Purchase, you hereby agree & consent not to:

Abuse or harass any person through or on the Site.

Post or transmit obscene, offensive, defamatory, pornographic, or abusive content, as well as content that infringes our intellectual property rights or those of another person, website, or company.

Use the Site in any way or for any purpose, which violates any law of the United States and the jurisdiction in which you use the Site.

Post or transmit any “spam” or unwanted, unsolicited content.

Post copyrighted materials, photographs, or content, which do not belong to you.

Promote or sell your own content, services, or products through the Site, or the content, services, or products of anyone else other than us.

Copy, download, share, post, or transmit our intellectual property in any way that infringes on our intellectual property rights.

Our refund & cancellation policy

A course of group mat classes is priced at a discounted rate for paying in advance and applies to that block of classes only. This discount does not apply to a part booking of the course.

If you do not pay for a block of classes in advance you have the option to Pay as You Go at £10.00 per class (if there is a space available - no space can be held in any class unless a course has been paid for in advance), payable on the day

Classes cannot be held in credit to be used on other courses and no further reduction in price is offered for a course

Refunds will not be issued for individual discounted classes that are part of a course. A 24 hour cancellation policy will apply to private 1:1 or duet classes and full course purchases.

N.B If you are unable to attend any of your classes due to exceptional circumstances, you may be able to attend another class in the same week offered at the discretion of your teacher and subject to space being available.

Health and medical disclaimer

The material (“Content”) provided and taught by Kefi Wellness is educational and informational in nature and is provided only as general information. By using the Site, or Purchasing or Downloading from our Site, partaking in/purchasing Courses, Services, and/or Products; such use shall constitute your agreement that the Site, Courses, Services, and/or Products is not professional medical advice and shall not be relied upon by you as such

Information and resources are based on the opinions and experience of the author and not a substitute for medical counselling or treatment, are not offered to diagnose or prescribe for medical or psychological conditions nor to claim to prevent, treat, mitigate or cure such conditions, nor to make recommendations for treatment of disease or to provide diagnosis, care, treatment or rehabilitation of individuals, or apply medical, mental health or human development principles.

Any and all current or past-client testimonials, statements, or examples used by us are simply that: examples. They are not guarantees that you will also experience or receive the same results. Each client and his/her circumstances are unique and nothing shall be interpreted as a guarantee that you will experience the same results as another client of ours.

Limitation of liability

Kefi Wellness is not responsible or liable in any way for any and all damages you receive directly or indirectly from your use of the Site, or Purchasing or Downloading from our Site, partaking in/purchasing classes, Courses, Services, and/or Products. No liability exists Kefi Wellness or anyone who works for or volunteers for Kefi Wellness nor can they be held responsible for any allergy, illness or injurious effect that any person or animal may suffer as a result of consuming any product by or recommended by Kefi Wellness. We do not assume liability for damages, injuries, harm, death, misuse of (or failure to properly use) instructions, advice, information or documents, due to any act, or failure to act or notify, by you or the negligence of another participant in the class/studio . Notwithstanding anything to the contrary contained herein, your sole and exclusive remedy for negligence, failure to perform, or breach by us shall be a refund of the amount paid for such service or product. In no event shall we be liable to you for any indirect, special, exemplary, or consequential damages. No liability exists for Kefi Wellness or anyone who works for or volunteers for Kefi Wellness nor can they be held responsible for any allergy, illness or injurious effect that any person or animal may suffer as a result of consuming any product by or recommended by Kefi Wellness.

Intellectual property ownership

The Site and its Content are intellectual property solely owned by Kefi Wellness. The Site and its content are protected by copyright and trademark laws, as well as intellectual property laws. Any violations of this term, and all terms contained herein, will be legally pursued to the fullest extent permitted by law.

Our limited license to you

If you view, access, or Purchase the Site, Courses, Services, and/or Products, you are considered our Limited Licensee (“Licensee”). As a Licensee, you agree and understand that the Site, Courses, Services, and/or Products have been written, created, drafted, invented, and developed by us after a significant investment of time, money, education and effort. We take the protection of our Site, Courses, Services, and/or Products very seriously. Kefi Wellness grants you a non-exclusive, non-transferable, revocable license to access and use our Website and Services strictly in accordance with this Agreement. During the course of your use, Received documents, Services, Purchases, and/or Downloads from Kefi Wellness you agree and understand that you cannot distribute, copy, forward, and/or share information prohibited by these Terms & Conditions. You also agree and understand that you are to take all necessary steps to make sure that you do not inadvertently share or distribute said materials, including, but not limited to, protecting your password (if any) to the Site to access your Purchase or Download.

You may not use our Content to:

· Develop a competing website.

· Create compilations or derivative works as defined under copyright laws. Re-distribute it in any manner, including, but not limited to, sale, license, lease, rental, subscription, or any other distribution mechanism.

· Decompile, disassemble or reverse engineer our Website, Services, and any related software.

Any violations of these Terms & Conditions will be legally pursued to the fullest extent permitted by law.

Sharing content from Kefi Wellness

You must contact us to request and receive written permission before sharing documents, our Site and its Content for commercial purposes. You may share the site only for personal purposes, but we ask that you link directly to the Site. You are required to give us and the Site credit by linking to the Site and its Content if you share it on social media or your own website, including all photographs. Since the Site and its Content are not yours, you may not in any way imply or represent that the Site or its Content are yours or that you in any way created, caused, or contributed to the Site or its Content. You may not make any claims that you are in any way associated with Kefi Wellness.

Payment & Order Acceptance

Terms of payment are within our sole discretion and payment must be received by us in full before our acceptance of an order, confirmation of your booking and reservation . Any bookings not confirmed with payment cannot be held.

You agree that your order is an offer to buy, under these Terms, all products and services listed in your order. All orders must be accepted by us or we will not be obligated to sell the products or services to you. We may choose not to accept orders at our sole discretion, even after we send you a confirmation email with your order number and details of the items you have ordered.

All prices, discounts, and promotions posted on this Site are subject to change without notice. The price charged for a product or service will be the price advertised on this Site at the time the order is placed, subject to the terms of any promotions or discounts that may be applicable. The price charged will be clearly stated in your order confirmation email. Price increases will only apply to orders placed after the time of the increase. If you elect the instalment or “pay over time” option at checkout, you agree that Kefi Wellness has permission to automatically charge, without checking with you before each instalment transaction is charged, the amount due on the date(s) agreed upon at checkout. If your payment method fails or is otherwise declined, you will be removed from, or cancelled from having access to our Courses, Services, and Products. Please note, in the event your payment method is declined at any time, you are still responsible for the full cost of your Purchase. You represent and warrant that (i) the credit card information you supply to us is true, correct and complete, (ii) you are duly authorised to use such credit card for the purchase, (iii) charges incurred by you will be honoured by your credit card company, and (iv) you will pay charges incurred by you at the posted prices, including shipping and handling charges and all applicable taxes, if any, regardless of the amount quoted on the Site at the time of your order.

We do not accept any chargeback threats (real or threatened). If any chargebacks are placed on a Purchase or Download of our Courses, Services, and Products, we will report said incident to the major credit reporting agencies. Doing so could have a negative impact on your credit report and/or credit score. Should we need to do so and you would like to have this report removed from your credit report, please contact us to arrange for payment owed. Once payment owed is received, we will make the appropriate reports to the credit agencies.

Payment processing companies may have different privacy policies and practices than we do. We are not responsible for the policies of the payment processing companies. As with any online purchase, there are circumstances beyond our control, which may compromise your credit card or payment method. We are not liable or responsible for any of those circumstances.

You hereby release us from any and all damages related to your payment or use of our payment processing companies in which you incur and further agree not to assert any claims against them or us for any damages, which arise from your Purchase, or use of our Site and its Content.
